"The Role of Data Localisation in Cybercrime Investigations" – a chapter by LINK Centre Sessional Lecturer, Melody Musoni published in the open access De Gruyter volume, African Data Protection Laws: Regulation, Policy, and Practice.

In her chapter, Melody Musoni discusses the different legal and policy interventions on data localisation measures adopted by African countries. She highlights that these measures are implemented to make data more accessible for law enforcement purposes, particularly across borders. Musoni questions the effectiveness of data localisation measures, including in addressing cybersecurity and cybercrime. She concludes by providing alternative solutions for law enforcement to access electronic evidence.

This chapter contains some discussions extracted from Musoni’s PhD thesis titled, “Legal challenges of establishing jurisdiction over cloud data: Addressing the gaps in South Africa’s cyber crime legislative framework”, University of the Witwatersrand, 2023.
